Partner Stuart Glass obtained a defense verdict in Supreme Court Kings County. Plaintiff claimed that in the course of his employ as a MTA Bus inspector he was caused to trip and fall in an unguarded excavation. It was claimed that our client had negligently failed to properly safeguard a 100 foot long trench that our client had excavated. After securing dismissal of the Labor Law claims via a summary judgment motion, the case proceeded to trial with plaintiff being represented by one of the top personal injury firms in New York and the co-defendants being represented by two nationally recognized defense firms. Following the liability phase, the jury found all defendants were negligent, but that only our client’s negligence was not a substantial factor in causing the accident. On cross examination of the plaintiff and plaintiff’s liability expert, Mr. Glass secured testimony that essentially negated the claims against our client, who created the underlying condition.
