Partner Emeritus Gil Coogler and Brian Thorn won a full defense award at an arbitration hearing defending a solar installation company against claims of Breach of Contract, Breach of Warranty and Fraud and were awarded fees and costs.  The decision noted that FP established that the petitioner’s claim was speculative, that our insured acted in accord with industry standards and that the pre-existing defects in the structure were not covered by the warranty.  Moreover, FP successfully defended the fraud claims that would have allowed for treble damages.  The combined efforts of our commercial litigation and construction defect practice groups were instrumental in defeating these claims.
